The NBA legend Testifies He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and status as a newcomer emboldened his push for 23XI Racing to “challenge” Nascar over perceived violations of competition laws.

Team Investment and a Competitive Drive

Jordan shared operational insights of his racing venture, revealing he invested $40 million of his personal wealth into the Cup Series operation launched with business partner Curtis Polk and driver Hamlin.

“It fell to someone to act,” Jordan said in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport it needed to be looked at from a different view.”

The Core Dispute: Franchise System and Renewal Demands

At issue is the end of a 2016 agreement where Nascar granted each team a “charter”. This system mirrors other professional sports with independent franchises, such as the Charlotte Hornets or the NFL’s Panthers. This deal was due to end in 2024 when Nascar insisted on teams renew their charters.

Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with onlookers and reporters vying for a view or a picture of the global icon.

Spearheading the Fight

Jordan’s 23XI is at the forefront of the push along with another racing team for Nascar to change a business model Jordan contended is breaking the law to keep two hands on the wheel.

For Jordan and and a fellow team representative, who preceded Jordan, are events from last September. Gibbs described a hectic and tense six hours where the sanctioning body told teams they must sign a charter agreement extension. The document spanned 112 pages outlining team compensation and a guaranteed spot in Nascar-sponsored races.

A Refusal to Sign

Jordan said that his team and its ally decided their only feasible option was to decline to sign that extensive document and litigate the matter. All other teams signed the agreement.

The team owners approached Nascar about potential amendments or negotiations. Nascar refused to engage, Jordan said.

The Ultimate Motivation: Winning

But in the end, the pushback against what he saw as a financially unsustainable model was driven by the usual bottom line for Jordan: Winning.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he testified, sharing that he bought a third charter last year for $28m amid the legal dispute. “So I dove in.”

Heather Gibbs’ Testimony

Heather Gibbs detailed her request for permanent charters, which she said a written letter to Nascar. She testified the pressure of the contract signing demand was problematic.

According to her, Joe Gibbs first attempted to call and persuade Nascar against forcing signatures, but Nascar’s leader declined the request.

“Please don’t force this on us,” Gibbs recounted was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, that’s the number.”
